1. Introduction
 
1. Participation in this Competition is governed by these terms and conditions (“the Rules”).
 
2. This competition is operated by Melbro Wholesale (Pty) Ltd (“the Promoter”)
 
3. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.
 
2. Eligibility
 
1. This Competition is limited to citizens of or legal residents in South Africa, Namibia, Botswana, Lesotho and Eswatini (“Southern Africa”)
 
2. The following persons shall not be eligible to participate in this Competition:
* Directors and employees of the Promoter, or their spouses, life partners, parents, children, brothers, sisters, business partners or associates * Persons under the age of 18 years.
 
3. Mechanics
 
1.  To participate in this Competition, Participants are required to purchase one of the Nutribullet branded products listed in “Schedule A” from a retail store in South or Southern Africa between 3rd October 2022 and 30th November 2022.
 
2.Having made the purchase, Participants are required to (a) Scan the QR code or save this number 064 915 5450 (b) send the proof of purchase receipt to the WhatsApp number and then (c) follow the ensuing prompts. Entry costs are as per Participant’s standard WhatsApp data usage; there are no additional entry fees payable.

 
3.Participants are required to keep their till slip as proof of purchase to constitute a valid entry. Failure to do so will result in ineligibility for the prize. 
 
 
4. The Prize
 
1.Participants stand a chance to win a travel voucher to the value of R75 000.
 
2.The itinerary for the trip has not been pre-planned and the winner will be responsible for all planning and logistics, in direct liaison with the designated travel agent.
 
3.The prize value does not include the costs of obtaining a visa or travel insurance or any ancillary expenses. Those are all for the account of the participant. 
4. The travel voucher will be valid for redemption from 5 December 2022 – 31 August 2023
5. The voucher is non-transferable and cannot be exchanged for cash.

6. The Draw:
 
1. The winner will be chosen by means of a random draw from amongst eligible participants
  
2. The lucky draw winner will be contacted telephonically by a representative of the Promoter and will be required to answer a few questions regarding his/her eligibility and will be requested to submit certain documents, notably including a copy of his/her till slip to the Promoter’s representative.
 
3. Should the lucky draw winner not meet the eligibility requirements; the prize will be forfeited and another name will be randomly drawn. 
 
 7. General 
 
1.Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
 
2.All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnify and hold harmless the Promoter, its directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of the Promoter.
 
3.The Promoter, its directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
 
4.The Promoter, its directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of the prize nor in respect of any warranties or undertakings given by any person other than the Promoter itself.
 
5.The Promoter reserves the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
 
6.By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoter to comply with its obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
 
7.These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa.
 
8.The participants and the Promoter consent to the non-exclusive jurisdiction of the High Court of South Africa.
 

9.Participants agree that if they win the lucky draw prize, they will allow the Promoter to use their name and image in promotional material.

 
10.The decision of the promoter will be final on all issues relating to the competition and no correspondence will be entered into.

11. The Promoter will use reasonable efforts in order to ensure that any information, including personal information. provided by participants, or which is collected from them, is stored in a secure manner. Any information collected by the Promoter may be used to send participants information about products, services and special offers that may be of interest or value to them. The information may also be processed by the Promoter or any of its operators, agents and sub-contractors on the condition that they will keep such information confidential.
